SUPREME PEOPLE’S COURT ANNOUNCES 08 MORE NEW PRECEDENTS

According to Decision No. 50/QD-CA issued by the Chief Justice of the Supreme People’s Court and coming into effect from February 25, 2020:

– Accordingly, 08 more new precedents are announced and will be applied to trials from April 15, 2020, including

(i) Precedent No. 30/2020/AL on deliberate acts of running traffic vehicles over victims after occurrences of traffic accidents;

(ii) Precedent No. 31/2020/AL on determining the rights to rent, to buy houses belonging to the State under Decree No. 61/CP dated July 05, 1994 of the Government to be property rights;

(iii) Precedent No. 32/2020/AL on cases of lands reclaimed by individuals who later departed to reside abroad and now used and managed by someone else for stable and long term;

(iv) Precedent No. 33/2020/AL on the case of individuals to whom the state allocated land but did not use and let someone else manage and use such for stable and long term;

(v) Precedent No. 34/2020/AL on the right to write wills to decide land compensation values in cases of lands being recovered by the State with compensation;

(vi) Precedent No. 35/2020/AL on Vietnamese individuals who allocated land to domestic individuals for use prior to residing abroad;

(vii) Precedent No. 36/2020/AL on the effectiveness of land use right mortgage agreements in the case of revocation/termination of land use right certificates;

(viii) Precedent No. 37/2020/AL on the effectiveness of property insurance contracts in case the insurance buyer pays premiums after the time limit for paying premiums has expired.
