Pursuant to Official letter No.1064/LĐTBXH-BHXH issued on March 18, 2019:
The foreign worker shall be required to participate in the compulsory social insurance program if he/she meets all of the following conditions:
- He/she obtains work permit, practicing certificate, practicing licenses issued in Vietnam;
- He/she hasindefinite-term employment contract or employment contract valid for at least one year with employer in Vietnam;
- He/she does not reach full 60 years of age, for males, or full 55 years of age, for females;
- He/she is not intra-company transferee as stipulated in clause 1 Article 3 of Decree No. 11/2016/ND-CP, including the managers, chief executive officers, experts and technicians of a foreign enterprise which has established a commercial presence in Vietnam, are temporarily reassigned within the same enterprise to its commercial presence in Vietnam and have been employed by the foreign enterprise for at least 12 months.
