On December 15, 2021, the Vietnam General Confederation of Labor issued Decision No. 3749/QD-TLD dated December 15, 2021 on spending support for union members and employees affected by the Covid-19 pandemic (Hereinafter referred to as “Decision”). In which, certain notable points of this Decision are stipulated as follows:
1. Objects and levels of support for union members and employees affected by the Covid-19 pandemic
(i) Union members and employees who are F0 cases and do not violate the provisions of the law on Covid-19 prevention and control are supported:
• The maximum amount is VND3,000,000/person if there are serious symptoms of illness and must be treated for 21 days or more at a hospital or medical facility that is allowed to collect Covid-19 treatment according to the documents certificated by the competent medical authority.
• The maximum amount is VND1,500,000/person if they have to undergo outpatient treatment for 21 days or more or inpatient treatment for less than 21 days at a hospital or medical facility that is entitled to receive treatment for Covid-19 according to certification documents of the competent health authority.
(ii) Union members and employees at agencies, units, and enterprises that pay trade union fees die due to infection with Sars-CoV-2 virus, their relatives shall be supported at VND5,000,000/person.
(iii) Other cases affected by the Covid-19 pandemic need support to assign the Standing Committee of the Provincial and Municipal Labor Confederations, the Central Sector Trade Union and equivalent, the Corporation’s Trade Union under the General Confederation, the Grassroots immediate superior delegation actively considers and decides according to the provisions on financial decentralization of the General Confederation in accordance with the actual situation, the requirements of pandemic prevention and control and the approved financial sources of the trade union in a year.
2. Supporting trade union officials to participate in the fight against Covid-19
(i) Trade union officials at the grassroots level, union members and employees mobilized by their superior trade union to participate in the prevention and control of the Covid-9 pandemic are supported from VND100,000 to VND150,000/person/day from all days off, public holidays, Tet, depending on the nature, level, work and actual number of days of pandemic prevention and control, but not exceeding VND2,000,000/person/year. Assign Standing Committees of Trade Unions at all levels to assign decision and take responsibility.
(ii) Grassroots trade union officials at enterprises, agencies and units: the support level is from VND80,000 to VND120,000/person/day, including weekends, holidays, and Tet, depending on the nature, extent, and work and the actual number of days of anti-epidemic but not exceeding VND1,500,000/person/year. The Grassroots Trade Unions Executive Committees balances itself in the approved financial resources to decide and take responsibility.
(iii) Trade union officials participating in the prevention and control of pandemic infected with Covid-19 are entitled to the regimes specified in Article 1 of this Decision.
Each F0 subject was supported only once despite being positive for Sars-CoV-2 multiple times. In case a person belonging to many subjects is entitled to different levels of support, he/she shall only be entitled to the object with the highest level of support. In case a person received support when he/she was F0 and later died due to Covid-19, his/her relatives will be supported according to Clause 2, Article 1 of this Decision.
4. Funding for implementation
Funding sources for expenditures to support under this Decision (excluding the content of Clause 2, Article 2) are balanced in the annual trade union financial revenue and expenditure estimates, accumulated finance and socialization sources at the provincial and city labor unions, central branch trade unions and the equivalent, trade unions of corporations directly under the General Confederation, trade unions of the immediate superior at grassroots level. In case the units cannot balance their own revenue and expenditure, they must request the General Confederation for support, then support to the General Confederation for consideration and decision.
[Decision No. 3749/QD-TLD takes effect from December 15, 2021 and replaces Decision No. 2606/QD-TLD dated May 19, 2021 and Decision No. 3022/QD-TLD dated August 9, 2021].
