REQUIRED CONDITIONS WHEN EXTENDING THE LABOR CONTRACT BY THE APPENDIX

The extension terms of the labor contract must be agreed by the employee, the company cannot decide on its own this issue;

ONLY EXTEND 01 TIME (01)  FOR A LABOR CONTRACT;

According to regulations, the labor contract with a duration of under 12 months can be used the Appendix to extend, however, the issue is unclear because many people explain that they must sign the definite-term labor contract when having a job with regular nature!

TOTAL OF PERIOD OF THE LABOR CONTRACT AND THE APPENDIX DO NOT CHANGE THE NATURE OF THE LABOR CONTRACT.

The total period of the signed Labor contract  and the Appendix accordingly must not be exceeded 36 months if it is a definite-term labor contract. (If the Labor contract has a duration under 12 months, the total period above shall not exceed 12 months, please note the issue above is still controversial).

THE APPENDIX MUST BE SIGNED ON TERM OF THE LABOR CONTRACT.

The appendix is to adjust/modify the Labor contract. Extending by the Appendix is to adjust the duration of the Labor contract and the additional appendix should be amended only when the labor contract is still valid.
