04 NEW NOTEWORTHY REGULATIONS ON LABOR ACCIDENT AND OCCUPATIONAL DISEASE REGIME SHALL APPLY FROM SEPTEMBER 15, 2020

Pursuant to Decree No. 88/2020/ND-CP issued by Government on July 09, 2020 and coming into effect from September 15, 2020:

– Accordingly, a number of new regulations on labor accident and occupational disease regime specified in Decree No. 88/2020/ND-CP are as follows:

(i) The Employee shall be eligible for receiving supports for 100% of the cost of occupational disease treatment: Comparasion to Decree 37/2016/ND-CP, the current support rate shall be 100% of the cost of occupational disease treatment instead of 50% as previous regulation. Besides, the support for cost of occupational disease treatment for employees with an occupational disease shall be also applied to their relatives.

(ii) The cost of occupational disease treatment shall not exceed VND 15 million: Comparasion to Decree No. 37/2016/ND-CP, the current support rate for cost of occupational disease treatment for employee shall be limited to a specific amount instead of not exceeding ten times the statutory pay rate/person as previous regulation;

(iii) Reducing one of the conditions for support for cost of occupational disease treatment for Employees: according to the new Decree, the condition for the Employer to organize occupational disease examination for the Employee has been abolished.

(iv) Emloyees who do not leave their job are not entitle to convalescence:

• Pursuant to Article 9 of Decree 88/2020/ND-CP provides for the number of days of convalescence and health rehabilitation after treatment of injuries and diseases, including public holidays, New Year holidays and weekends as prescribed by labor laws.

• In addition, Clause 2, Article 9 of this Decree also provides for the Employees who do not leave their jobs are not entitled to convalescence and health rehabilitation after treatment of injuries or diseases.
